Vexatious FOI requests?

Freedom Of Information requests made

Using the website WhatDoTheyKnow over the past 8 mths I’ve submitted the 3 questions in relation to the proposed building of a New Civic Centre.

6th June 2012

Dear Stoke on Trent City Council,

Please provide the list of Council Buildings across the City that
are under consideration to close and relocate to the City Business
District

Please provide for each building

1. Name and Location of the Building
2. If Council owned or rented the building
3. Number of Staff Based in the building
4. Plans for future of building
5. Cost of backlog maintenance per building

The City Council recently ran a soft marketing exercise to seek
expressions of interest from developers for the Former Spode Works,
the Civic Centre, Stoke Town Hall, King’s Hall, Gordon House and
Kingsway car park.

This ended on 14th December 2012, please provide the number of
expressions of interest received by this date for.

1. The Package as a whole, all the sites on offer

2. Combination of sites and which sites they were eg.
Spode and the Civic: 12 expressions
Town Hall and Kingsway: 7 expressions

3. Individual sites, the number of expressions for each site on its
own, not in combination.

Dear Stoke on Trent City Council,

The City Council used consultants such as the Tribal group to
examine procuring a Strategic Partnership for Support Services, I
believe the proposal for outsourcing of back office workers is no
longer a viable proposition, can you now make available:

The reports produced by Tribal and any other Consultants involved
in around 2005 onwards to look at approving a Strategic Partnership
for Support Services and a move to Hanley, along with the Officers
reports to approve and the officers reports to Councillors?

The reports produced by Tribal and any other Consultants involved
in around 2010 to which looked at discontinuing the Strategic
Partnership for Support Services and with the move to Hanley, along
with the Officers reports to discontinue and the officers reports
to Councillors??

As well as the proposal no longer being an option and hence the
information will no longer have any impact on the past discontinued
scheme, Information is not exempt if it relates to proposed
development for which the local planning authority may grant itself
planning permission pursuant to Regulation 3 of the Town & Country
Planning General Regulations 1992(a).

Consultation

Recently Genr8 held a consultation event on the new Civic Centre, of which I was took part in, before the event I contacted the Press department for some media to place on the internet

can you please provide consultation plans and brochures so they can be made available online for viewing?
Have you an online form for feedback? or is this email address suitable for submissions?
Is this Part of the new Civic Centre or has another Investor come along to invest in CBD?
Have you secured an occupier for the 2nd building?
if so can you reveal at this stage who they are?
If we now have a 3rd Party, is there still need for the Civic Centre to Move?
When will the 3rd Party investor be named?

Following the event I contacted the Highways Department and the Planning Depratment of a view on what I had been informed of at the consultation event.

Having attended the Genr8 Consultation on 1st March, I would like to ask for your opinion on likelihood of their proposals succeeding and if they have been discussed with yourself

1 on-street parking on Warner Street?
What is the Capacity on Warner Street?
Are the current parking restriction to be removed?

2 on-street parking on Potteries Way?
Is this even feasible did seem an out the box proposal

3 under ground car parking?
Do the ground conditions, and future energy extract make this feasible?
What would be the likely addition cost to a developer, or would the Council fund it?

4 Cannon Place was suggested as having plenty of space.
I believe Cannon Place and Hinde Street are both ear marked for future phases of CBD.
Would such a temporary measure be acceptable to yourselves?

Both of these e-mails where forwarded onto the Information Rights Department, I have since received the below email

It has been noted that you have made a number of requests to the City Council over a short period of time for information in relation to the Central Business District and the relocation of the Council to Hanley.

 The Council is required to treat any request received and process it under the Freedom of Information Act 2000. This is regardless of to whom the request was sent or the legislation under which the requester would like the request to be handled. The Council does not have the option to regard any request as ‘Not under the Freedom of Information Act’ regardless of any desire the requester may express to the contrary.

 Where a number of requests are received, not necessarily from the same person, and they relate to the same or similar subjects then the Council is entitled to refuse these requests under Section 14(2) of the Act as they are regarded as being repeated. Also the Section14(1) permits the Council to refuse requests from a requester where it is considered that the requests are vexatious in intent or where it is apparent that the intent of the requests is to impede the operation of a public authority.   Any further requests from you in relation to the Central Business District and the relocation of the Council to Hanley will not be processed and will be filed and not acknowledged.
